In late December International Trade Commission (ITC) put the ban on HTC Android devices because of infringing upon one of Apple’s patent #5,946,647 on importing the number of HTC devices. That certainly halted the shipment of HTC One X and HTC Evo 4G at US customs as the agency is doing further investigation with Apple over the patent issue, and till the time shipment has been held back. The patent was about “data tapping” (context-sensitive text-based actions) in the browser and messaging apps on some of the HTC phones, which was later removed from HTC One X and Evo 4G LTE. HTC further says:
The US availability of the HTC One X and HTC EVO 4G LTE has been delayed due to a standard U.S. Customs review of shipments that is required after an ITC exclusion order. We believe we are in compliance with the ruling and HTC is working closely with Customs to secure approval. The HTC One X and HTC EVO 4G LTE have been received enthusiastically by customers and we appreciate their patience as we work to get these products into their hands as soon as possible.
The ITC ordered was made before the One X was announced at Mobile World Congress (MWC), and it was done broadly prohibiting the import of HTC devices running Android that infringe the patent. Even HTC One X is also out of stock in AT&T’s website and Evo 4G LTE is due to get in sale from the coming friday.
